1. Eligibility

The Players’ Tribune Newsletter Survey Sweepstakes (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States (and the District of Columbia), Puerto Rico, and Canada (except Quebec) who are at least eighteen (13) years old at the time of entry. Void where prohibited by law. Employees of The Players’ Tribune, Inc. or any of its respective affiliates, subsidiaries, advertising agencies, suppliers, distributors, retailers or any other company or individual involved with the design, production, execution or distribution of the Sweepstakes and their immediate family (spouse, parents and stepparents, siblings and stepsiblings, and children and stepchildren) and household members (people who share the same residence at least three (3) months out of the year) of each such employee are not eligible. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.  his Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with Facebook, Instagram or Twitter.

1. Sponsor

1. Sweepstakes Entry Period

The Sweepstakes entry period starts on 12/13/2017 at 12:01 a.m. Eastern Time (“ET”) and ends the sooner of 12/20/2017 at 11:59 p.m. ET (the “Sweepstakes Entry Period”). Sponsor is the official time keeper for this Sweepstakes.

1. How to Enter

During the Sweepstakes Entry Period you can enter online at www.surveymonkey.com/r/tptnewsletter by providing the required information, including your email address. After you provide all the required information you will receive one (1) entry into the Sweepstakes. Limit one (1) entry per person. Entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries will void that entrant’s entries and that entrant will be disqualified. Use of any automated system to enter is prohibited and will result in disqualification. In the event of a dispute as to any entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet Access Provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder. All entries become the sole and exclusive property of Sponsor and will not be returned.

1. Winner Selection

One day after the end of the Sweepstakes Entry Period, the Sponsor will select entries for the prize described below in a random drawing from among all valid entries received during the Sweepstakes Entry Period. Selected winners will be contacted using the email address provided when entering and will be awarded the prize (subject to verification of eligibility and compliance with the terms of these Official Rules). Potential winners will be notified approximately one (1) day after the prize drawing. Failure to respond to the initial verification contact within three (3) days of notification or return of email notification as undeliverable after three (3) attempts may, in Sponsor’s sole discretion, result in disqualification. Before any potential winner who is a resident of Canada can be declared a winner of the applicable Prize, he/she must first correctly answer a time-limited mathematical skill-testing question without assistance of any kind whether mechanical, electronic or otherwise.  .Odds of winning the prize depend on the number of eligible entries received during the Sweepstakes Entry Period.

1. THE POTENTIAL SWEEPSTAKES WINNER MAY BE SUBJECT TO VERIFICATION BY SPONSOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES.
2. Verification of Potential Winners

The potential prize winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. The potential prize winners may be required to sign and return to Sponsor within three (3) days of the date notice is sent, an affidavit of eligibility, and liability/publicity release (except where prohibited) in order to claim his/her prize. If a potential winner cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release, or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. In the event that a potential winner of a Sweepstakes prize is disqualified for any reason, Sponsor may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.

1. Prize

AMEX Gift Card.  Approximate retail value of each grand prize is $250.00. Actual/appraised value may differ at time of prize award.  No cash equivalent for the prize, prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the listed prize for one of equal or greater value for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use.  Sponsor will not replace any lost or stolen prize.

1. Entry Conditions and Release

By entering, each entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor, which are binding and final in all matters relating to this Sweepstakes; (b) release and hold harmless the Sponsor and its respective parent, subsidiary and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Sweepstakes and/or entrant’s acceptance, use or misuse of any prize. 

1. Publicity

Except where prohibited, participation in the Sweepstakes constitutes winner’s consent to Sponsor’s use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

1. General Conditions

Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

1. Limitations of Liability

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, or programming associated with or used in the Sweepstakes; (b) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error, which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. Proof of entering information at the Website does not constitute delivery or receipt. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes. No more than the stated number of prizes will be awarded.

1. Disputes

This Sweepstakes is governed by, and will be construed in accordance with, the laws of the State of New York.   Except where prohibited by law, as a condition of participating in the Sweepstakes, Entrant agrees that (1) all disputes and causes of action arising out of or connected with the Sweepstakes, shall be resolved through mandatory and binding arbitration under the rules of the Judicial Arbitration and Mediation Services, Inc. (“JAMS”) and consistent with JAMS’ Policy on Consumer Arbitrations Pursuant to Pre-Dispute Clauses Minimum Standards of Procedural Fairness.  The parties expressly waive any ability to maintain any class action in any forum and any arbitration, claim or other proceedings shall be conducted on an individual basis and not in any class action, mass action, or on a consolidated or representative basis. Entrant further agrees that the arbitrator shall have no authority to award class-wide relief or to combine or aggregate similar claims or unrelated transactions. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim or seek injunctive relief or any other equitable claim.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU and does not apply to New Jersey residents or transactions.

Information collected from entrants is subject to the Sponsor’s Privacy Policy, which is available at http://www.theplayerstribune.com/privacy/.

1. Sweepstakes Results

For Sweepstakes results, send a hand-printed, self-addressed, stamped envelope identifying the Sweepstakes to Winner’s List, The Players’ Tribune, Inc., 601 W. 26th Street; Suite 1435, New York, NY 10001. Requests for the Winner’s List must be received 60 days after the end of the Sweepstakes Entry Period.
